I have read several posts regarding Dynamic Towing's "Cash Only" policy. I believe this is illegal in the State of California. Any response from the Board or Vintage Management is encouraged.
This community needs structure and enforceable rules, not pirates looking to make a quick buck off the backs of hard working, often low income families.
Security should be contacted before towing & issue warning citations. This would require security or the board to keep records of citations issued. One subsequent violation would be subject to board imposed fines. Third violation would result in towing.
I've witnessed DynamicTowing cruising through the complex, looking for violations.This company is judge & jury.I assume they are authorized to do this by the Board & Vintage Management. This practice is a liability lawsuit waiting to happen. I suppose Dynamic, the Board & Vintage figure no one in this community would pursue such action. Low incomes, working & no time. Arrogance & ignorance are bliss...I'm just saying. Something needs to change. The current practice is unfair, unreasonable & potentially litigious.

I am the owner and a resident of 1453 N. Elderberry.
on September 22, 2009 I was unloading a box in my garage when my truck got towed. I was unloading the box and when I took the box to put it inside I noticed that there was a tow truck trying to take my truck.
He lifted the truck while I was there and when I asked him why he was towing my truck he stated that I could pay him $87.50 right there then and he would leave my truck. He did not bother stating the reason for him towing my truck While I was trying to stop him and talk to him he sped up and took my truck.
I immediately called Vintage Management but they said they are unable to help me and gave me the phone number for the towing company so I could get my truck back I called Dynamic Towing and they asked me to pay $299.50 and I did pay $ 299.50. Vintage Management also said that I would have to raise this issue in the monthly meeting which will be held on October 21.
I waited the whole month and went on October 21 to the meeting. However, when I got there I discovered that there was no meeting and that they decided to hold the meeting a day earlier without notifying the members.
The towing company has no reason to tow my truck as I just parked for literally a few minutes just to take the box out and put it in the garage. This is extremely unfair to residents like me as we have no way to unload anything heavy close to our houses.
I wrote a letter to property manager Mr John Bauer on 3rd of October 2009 but he never replied me .

When I first moved in in July of 2002, there were no parking permits, and aside from the occasional person from the Mountain Shadows Apartments parking in our lot, there were no parking issues either. The parking permits were an attempt to control who is parking on our property. I don't think there is anything wrong with the concept of trying to control what happens on our property, but there is definitely something wrong with the current system.

Homeowners,
Coming home late from work tonight I get a call from my residence saying that my car has been towed. Not only did Air Tight Security have my car towed, via Dynamic Towing, from a vistor/tow free zone, they did it improperly. I have yet to have the car sent to my mechanic to asses the total damage, but despit the amount, estimated roughly $2,500.00, I am deeply enraged about the situation.
Sharing this with you I hope to connect not only with my fellow homeowners/board members, but also with Vintage Management. As homeowners WE choose to have an HOA in order to service and improve our quality of living. Having a homeowners car towed is far from an improvement. There has got to be a better solution to this parking/towing issue.
Let us ask ourselves a few questions: Why do we not have any notification, parking fine, instead of unjustly towing a vehicle for a minor infraction. Why does Dynamic Towing post a "Cash Only" sign on their payment window, when California state law prohibits such unmoral business practice. Why do we not have a choice for a towing company? For that matter why does Air Tight Security, tow my car but claims that they provide no security in respect to crimes because that is not in their contract -- only parking violations... Is our parking that out of hand?

If a resident has a complaint regarding the towing company, they may forward it in writing to Haven Management. The Board of Directors contracts with the towing company to handle any parking violations, and will take any complaints regarding the towing company under advisement. However, any requests for reimbursement for towing should be handled directly with the towing company. Please understand Carefree Ontario HOA or Haven Management do NOT receive any of the funds collected from the towing of vehicles.

We have a constant problem with residents and their guests parking their vehicles on the lawns, between carports in front of garages, in the alley and fire lanes, two cars in one carport with one car parked on the lawn, and all of this is PROHEBITED. Your vehicles will be towed at your expense. If you need parking stickers please contact Haven.
